29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59) (a) On or about May 7, 2013, at the VA Medical Center located at 1030 Jefferson Ave, Memphis, TN, the employer exposed employees to chemicals (Tremco Cold Adhesive and Tremco Low Rise Foam Parts A & B) covered by the Hazard Communication Standard and did not have a written program available at the worksite that describes how the criteria for labeling, MSDS's, and training would be met. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
