29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: The employer does not ensure that employees that voluntarily wear tight fitting respirators are medically evaluated to prevent employee injury. This violation occurred on or about May 09, 2013, and at times prior thereto, when an employee in the chemical storage area was exposed to respiration hazards while wearing a Gerson brand half-face tight fitting respirator without having been medically evaluated. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all employees that are required to wear or voluntarily wear respirators are medically evaluated before being fit tested or wearing them in the workplace.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use: The employer does not ensure that employees have access to an eyewash and shower station for immediate emergency use while using corrosive materials that could cause an employee injury. This violation occurred on or about May 05, 2013, and at times prior thereto, when employees in the in chemical storage area were exposed to chemical hazards while transferring corrosive chemicals into smaller containers, without having access to an operable eyewash and shower station. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that eyewash and shower stations are installed and maintained in areas of the facility where chemicals that can harm the skin and eyes are handled by employees.

This violation occurred on or about May 09, 2013, throughout the facility when employees were exposed to struck-by hazards while blowing off equipment without reducing the air pressure below 30 p.s.i. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure the pressure of compressed air used for cleaning purposes is reduced below 30 p.s.i., chip guarding is used, and employees are not allowed to blow off their clothes with the compressed air.

29 CFR 1910.184(e)(4): The employer did not ensure that before use, each new, repaired, or reconditioned alloy steel chain sling, including all welded components in the sling assembly, was proof tested by the sling manufacturer or equivalent entity, in accordance with paragraph 5.2 of the American Society of Testing and Materials Specification A391-65, which is incorporated by reference as specified in �1910.6 (ANSI G61.1-1968). The employer did not retain a certificate of the proof test and did not make it available for examination: The employer does not proof test the sling assemblies being used to lift material. This violation occurred on or about May 09, 2013, and at times prior thereto, throughout the facility where jib crane operators were using shop made metal lifting devices as part of a sling assembly without being proof tested to lift and move material. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all sling assembly components are proof tested and the records of those tests are maintained.
