29 CFR 1926.652(a): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): On or about May 7, 2013, at the construction site located approximately one block north of Main Road on Carley Road in Springdale, Arkansas, employees were exposed to cave in hazards while working in an approximate twelve foot deep straight wall excavation without a protective system in place.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access. On or about May 7, 2013 and times prior thereto, at the excavation site located approximately one block north of Main Road on Carley Road in Springdale, Arkansas, employees were exposed to fall hazards while getting in and out of the excavation. The access ladder positioned on the side wall of the excavation did not extend above the landing surface.
