29 CFR 1910.22(a)(1): Place(s) of employment were not kept clean and orderly or in a sanitary condition. Employees working in and around the mixing room were exposed to fire and explosion hazards in that grain and other raw material dust was allowed to accumulate at depths of approximately 3 inches and the frequency of cleanup was not sufficient to keep the work area clean. 29 CFR 1903.19(d)(1) requires certification and documentation that the abatement of the above violation is complete.

29 CFR 1910.178(c)(2)(vii): Approved power-operated industrial trucks designated as DY, EE, or EX were not used in atmospheres in which combustible dust will not normally be in suspension in the air or will not be likely to be thrown into suspension by the normal operation of equipment or apparatus in quantities sufficient to produce explosive or ignitable mixtures but where deposits or accumulations of such dust may be ignited by arcs or sparks originating in the truck. Employees working in and around the mixing room were exposed to fire and explosion hazards in that the Caterpillar 938G high-loader industrial truck was not rated for Class II combustible dust areas. 29 CFR 1903.19(d)(1) requires certification and documentation that the abatement of the above violation is complete.
