29 CFR 1910.252(a)(2)(vi)(C): Cutting or welding was not prohibitied in the presence of explosive atmospheres (mixtures of flammable gases, vapors, liquids, or dusts with air), or explosive atmospheres that may develop inside uncleaned or improperly prepared tanks or equipment which have previously contained such materials, or that may develop in areas with an accumulation of combustible dusts: a) Job site, 511 Westland Road, Hickory, PA: On or about May 8, 2013, during oxygen and acetylene torch cutting activities, the employer did not prohibit cutting operations on containers that contained substances such as oil. An employee was trying to torch cut the top of a waste oil drum/barrel off, when an explosion occurred, resulting in burn injuries to the employee.

29 CFR 1910.252(a)(3)(i): Welding, cutting, or other hot work was performed on used drums, barrels, tanks or other containers without having been cleaned so thoroughly as to make absolutely certain that there were no flammable materials present or any substances such as greases, tars, acids, or other materials which when subjected to heat, that might have produced flammable or toxic vapors: a) Job site, 511 Westland Road, Hickory, PA: On or about May 8, 2013, during oxygen and acetylene torch cutting activities, the employer did not ensure the waste oil drums/barrels were thoroughly cleaned out prior to cutting on them. An employee was trying to torch cut the top of a waste oil drum/barrel off, when an explosion occurred, resulting in burn injuries to the employee.
