29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a)Independent Roofing, Inc. @ 2317 73rd Ave Ct., Greeley, CO 80631: On and before May 3rd, 2013, the controlling employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Two subcontractor crews working on two separate homes had employees working near edge of the roof on two-story residential homes without the use of a fall protection systems. The subcontractor employees were conducting roofing operations on the new single-family homes. The conditions exposed employees to a fall hazard of approximately 15 feet to the ground below. Independent Roofing, Inc. was previously cited for a violation of the same or substantially similar condition of this Occupational Safety and Health Standard 29 CFR 1926. 20(b)(2) which was contained in OSHA Inspection Number 313413049, Citation 1, Item 1a, issued on October 16, 2009, and became Final Order on November 9th, 2009, with respect to a workplace located at 1001-1007 48th Avenue, Greeley, CO 80634. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.
