29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminants chemical state and physical form: (Note: This standard was referenced by 29 CFR 1915.154 for shipyard activities.) A) In Building 1109 during cyanide destruction process chlorine gas was emitted in levels above the NIOSH IDLH level of 10 parts per million, and the employer had not evaluated this respiratory hazard and issued appropriate respiratory protection.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Note: this standard was referenced by 29 CFR 1915.1200, in relation to shipyard work.) A) In building 1109 the employer did not train employees on the hazards associated with chemicals that were byproducts of a cyanide destruction reaction, such as chlorine gas. There was no mention of chlorine gas in the employer's chemical hazard communication training materials for chemicals used in the process.
