OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards greater than 20 feet when working from an aerial lift: a) At the coal barge terminal, employees were re-cabling the Link-Belt TC318 crane at the boom head tip using a Genie Z-45 Aerial lift when an employee climbed out of the basket over the guardrail onto the crane boom. Employees were working at heights of greater than twenty (20) feet above the river. Feasible and acceptable methods of abatement to correct this hazard include, but are not limited to the following: 1) Only enter or exit the aerial lift basket by the manufacturers provided access gate. 2) Follow the manufacturers instructions for entering and exiting the aerial lifts basket. 3) Follow the American National Standards Institute: ANSI/SIA A92.5-2006: Boom Supported Elevating Work Platforms, Paragraph 7.10, Operator Warnings and Instructions. DISCLAIMER: (1) The employer is not limited to the abatement method(s) suggested by OSHA. (2) The employer is responsible for selecting and implementing an effective abatement method.

29 CFR 1910.305(g)(1)(iv)(C): Flexible cords and cables were used where run through doorways, windows, or similar openings: a) In the feed warehouse, a sump pump was used to remove water from the subbasement area and power was supplied by an extension cord that was run through two doorways to a receptacle in the MMC room. The cord was pinched in the two doorways.

29 CFR 1917.122(d): The minimum width of an employee exit was not 28 inches(71.12 cm): a) In the feed recovery warehouse, the third level stairs to the grain terminal barge tower had an exit access that measured 19 inches between the handrail and the I-beam support for the building. Employees' access was restricted to and from the barge tower and the upper levels of the feed warehouse.
