29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: a) U.S. 206 and Airpark Road, Princeton, NJ 08540: On or about April 11, 2013, employees working in a 7ft deep trench were not provided with a ladder for safe means of egress. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.602(c)(1)(vii): Unauthorized persons were allowed to ride on a powered industrial truck: a) U.S. 206 and Airpark Road, Princeton, NJ 08540: On or about April 11, 2013, an employee was exposed to struck-by hazards while riding on the side steps of a CAT 450E Backhoe - Loader. Riders are not permitted on the equipment without a seat and safety restraint system in place.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (34 degrees measured from the horizontal): a) U.S. 206 and Airpark Road, Princeton, NJ 08540: On or about April 11, 2013, employees were observed working in a 7ft deep trench with vertical sidewalls that were not adequately sloped, benched, shored or shielded to protect the employees from cave-ins. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
