29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact. (a) Ketchum-Challis Highway 75, on or about May 14, 2013, and at times prior thereto, employees doing tree stump removal, were not required to wear chaps to protect legs from contact with the chain saw. Note: Abatement certification is required for this item.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. (a) Ketchum-Challis Highway 75, on or about May 14, 2013, and at times prior thereto, employees doing manual scaling and exposed to 30-40 foot falls down a rocky hill, were not required to fall protection. Note: Abatement certification is required for this item.
