29 CFR 1926.501(b)(15): Each employee on a walking/working surface 6 feet (1.8 meters) or more above lower levels was not protected from falling by a guardrail system, safety net system, or personal fall arrest system: a) On or about 5/14/13, on construction site where a refrigerated Building for the storage of green beans was being erected, at 18834 Brant Reservation Rd., Irving, NY: Three employees were exposed to a potential fall of approx. 20 ft. while being transported from ground level to the roof of the building in a "homemade cage type work-platform". The platform was not a properly engineered platform of substancial construction and had no capacity label. It lacked midrails on both ends. The platform was raised in the air by the forks of a Gradall, Model 534D rough terrain forklift. The platform was not adequately secured to the mast, and there was a gap of about 20 inches between the forks and the mast of the truck. There was slack in the single securing chain and the chain was held together with a "Stanley" keychain hasp. ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems. a) On or about 5/14/13, on the roof of a refrigerated Building being erected for the storage of green beans, at 18834 Brant Rservation Rd., Irving, NY: Two employees were exposed to a potential fall of approx. 20 to 24 ft. from the edges of the roof while installing a metal standing seam roof. Both of employees were wearing full body harnesses & lanyards, but neither was tied off to the cable on the roof or any other anchorage point. NO ABATEMENT CERTIFICATION REQUIRED
