This condition exposed the employees to a fall hazard of up to at least approximately 16 feet.

CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards: (a)Garay Construction Inc. at 10856 Quintero St., Commerce City, CO 80022: The employer did not ensure that each employee engaged in construction activities had been trained to recognize the hazards associated with working at elevations over 6'. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. Employees working on-site had not received fall protection training before working at elevations over 6 feet. This condition exposed employees to the hazard of falling from an elevation of up to approximately 16 feet.

29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purposes for which they were designed: (a)Garay Construction Inc. at 10856 Quintero St., Commerce City, CO 80022: On May 14, 2013 the employer allowed an employee to use a stepladder in a manner other than its designed purpose. The step ladder was used in a closed position to assist in setting a truss by an employee which is contrary to its design. This condition exposed the employee to a fall hazard of approximately 27 feet.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary: (a)Garay Construction Inc. at 10856 Quintero St., Commerce City, CO 80022: On or before May 14, 2013, the employer did not train the employees in the proper use of ladders. This condition exposed the employee to a fall hazard of approximately 27 feet. Abatement Note: The employer shall ensure that each employee has been trained by a competent person in the following areas, as applicable: The nature of fall hazards in the work area; The correct procedures for erecting, maintaining, and disassembling the fall protection systems to be used; The proper construction, use, placement, and care in handling of all stairways and ladders; The maximum intended load-carrying capacities of ladders and The standards contained in this subpart.
