29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of job-sites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):     (a) Absolute Finish, 3420 Irving, Denver, CO:  On and before 5/3/2013, the controlling employer in charge of the work-site did not ensure a "competent person" conducted frequent inspections of the job-site to ensure the use of fall protection by sub-contractors employees working from heights above 6 feet.  As a result, a sub-contractors employees were observed installing soffit panels from an unguarded second story balcony deck.  Condition exposed employees to a fall hazard of approximately 10 feet.     (b) Absolute Finish, 3420 Irving, Denver, CO:  On and before 5/3/2013, the controlling employer in charge of the work-site did not ensure a "competent person" conducted frequent inspections of the job-site to ensure the use of fall protection by sub-contractors employees working from heights above 6 feet.  As a result, sub-contractors employees were observed installing soffit panels while standing on the lower roof section without fall protection.  Condition exposed employees to a fall hazard of approximately 10 feet.
