OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall, crush-by and struct-by hazards: a) Building 1079 - on or about May 15, 2013, the employer was using a GEHL RS5-34 #613156 forklift to elevate an employee with an unapproved platform such as, but not limited to a stack of 4-foot X 8-foot plywood sheeting. The manufacture of the GEHL forklift does allow this model to elevate personnel with an approved work platform. However, the unapproved work platform was not designed in accordance with ANSI/ITSDF B56.1, thus exposing employees to fall, crush-by and struck-by hazards. ABATEMENT CERTIFICATION IS REQUIRED
