29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems:       a)      Associates Warehousing Inc., 2845 East Westmoreland Street, Philadelphia, Pa- Employees worked at heights of approximately 35 to 40 feet above the lower level adding a new roof system to Building 1 and were not protected from falling by guardrail systems, safety net systems or personal fall arrest systems.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   a) Associates Warehousing Inc., 2845 East Westmoreland Street, Philadelphia, Pa- Employees worked at heights of approximately 35 to 40 feet above the lower level adding a new roof system to Building 1 and were not provided training in the recognition of fall hazards and the procedures to be followed to minimize the fall hazards.     NOTE:  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.1101(f)(2)(i): The employer with a work operation covered by the asbestos standard did not ensure that a "competent person" conducted an exposure assessment immediately before or at the initiation of the operation to ascertain expected exposures during that operation or workplace:    a)  Associates Warehousing Inc., 2845 East Westmoreland Street, Philadelphia, Pa- Employees worked adding a new roof system to Building 1 driving screws through the existing cementitious roof panels.  The employer did not conduct an exposure assessment for the work and could not produce any record of asbestos content for the material used in the existing roof.

29 CFR 1926.1101(k)(2)(i): Before work subject to this standard began, the building and/or facility owner(s) did not determine the presence, location and quantity of asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) at the worksite pursuant to 29 CFR 1926.1101(k)(1):    a)  Associates Warehousing Inc., 2845 East Westmoreland Street, Philadelphia, Pa- The facility owner had employees perform work on the existing cementitious roof of Building 1 and had not performed a determination of the presence, location and quantity of ACM or PACM.   b)  Associates Warehousing Inc., 2845 East Westmoreland Street, Philadelphia, Pa- The owner hired a roofing contractor to complete work on the existing cementitious roof of Building 1 and had not performed a determination of the presence, location and quantity of ACM or PACM.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1926.1101(o)(1): The employer did not designate a competent person on construction worksites, having the qualifications and authorities for ensuring worker safety and health required by 29 CFR 1926.1101(C), General Safety and Health Provisions for Construction 29 CFR 1926.20 through 29 CFR 1926.32:    a)Associates Warehousing Inc., 2845 East Westmoreland Street, Philadelphia, Pa- Employees worked installing a new roof system to Building 1 over an existing cementitious roof.  The replacement of the roof involved disturbing of the existing roof as PACM or class III asbestos work and no competent person was provided.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
