29 CFR 1926.55(a): Employee(s) were exposed to material(s) at concentrations above those specified in the Threshold Limit Values of Airborne Contaminants for 1970 of the American Conference of Governmental Industrial Hygienists:     Employees performing mortar grinding in preparation for tuck-pointing were exposed to airborne nuisance particulate and crystalline silica above the Permissible Exposure Limit and the employer did not ensure employee were protected.     A) An employee was exposed to an airborne concentration of nuisance particulate of 57.4 million particles per cubic foot of air (mppcf) with a severity of 1.148. The nuisance particulate had a silica percentage of 9.8% which resulted in a Permissible Exposure Limit of 16.9 mppcf and an exposure severity of 3.238.     B) An employee was exposed to an airborne concentration of nuisance particulate of 114 million particles per cubic foot of air (mppcf) with a severity of 2.28. The nuisance particulate had a silica percentage of 8.4% which resulted in a Permissible Exposure Limit of 18.7 mppcf and an exposure severity of 6.1.

29 CFR 1910.134(c)(1):  A written respiratory protection program that included the provisions in 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:       Employees performing tuck-pointing operations were exposed to respirable nuisance particulate inhalation hazards, crystalline silica inhalation hazards, and respirator use hazards and the written respiratory protection program had not been established by the employer and the written program did not include the following provisions:       a)     Procedures for selecting respirators for use in the workplace;   b)    Medical Evaluations for those employees required to wear respirators;   c)     Procedures for proper use of respirators in routine and reasonable foreseeable emergency situations;   d)    Procedures and schedules for cleaning, disinfecting, repairing, discarding and otherwise maintaining respirators;   e)     Procedures and schedules for changing cartridges and the method/means used to determine this schedule;   f)     Training employees in the respiratory hazards to which they are potentially exposed during routine and emergency situations;   g)    Training employees in the proper use of respirators;   h)     Procedures for regularly evaluating the effectiveness of the respiratory protection program.      Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
