29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    a) MSJ Contractors, LLC/ Raymond Evans - The employer did not provide training to their employees who were contracted to perform roofing work. Employees are exposed to fall hazards associated with working from an elevation above twenty feet. This was observed on May 14, 2013.

29 CFR 1926.501(b)(1):   "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.       a) MSJ Contractors,LLC/Raymond Evans- Employees were leaning over the side of a roof edge at the 11 Strawberry Street site [e.g. three stories from ground level]. The employer did not ensure that employees were not wearing any fall protection while throwing debris over the side of the building into a dump truck and on a tarp beneath it. This was observed on May 14, 2013.

29 CFR 1926.252(a): Whenever materials are dropped more than 20 feet to any point lying outside the exterior walls of the building, an enclosed chute of wood, or equivalent material, shall be used. For the purpose of this paragraph, an enclosed chute is a slide, closed in on all sides, through which material is moved from a high place to a lower one.   a) MSJ Contractors, LLC/Raymond Evans - The employer directed his employee to dispose of debris from a third floor window of a three story structure, which is 20 feet above ground level. The employer did not have a chute installed for the debris drifting outside of boundary tape, established around the work perimeter. This was observed on May 14, 2013.
