OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to: a) Alcor Corporation / 2100 Pittsburgh Ave, Erie, PA: On or about May 15, 2013 employees were exposed to struck-by and crush hazards from storage racks that were not maintained in a safe condition. Storage rack deficiencies included but were not limited to (1) Storage rack legs not being secured/anchored to the floor (2) Storage racks in use that contained damaged legs (3) Storage racks in use that contained damaged diagonal members (4) Storage racks in use with some areas out of plumb and out of straight limits (5) Storage racks in use that were not labeled with appropriate load ratings (6) Storage rack installation specifications, load application, and rack configuration drawings were not maintained at the work site.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) Alcor Corporation / 2100 Pittsburgh Avenue, Erie, PA --- Loading Dock Areas: On or about May 15, 2013 and at times prior thereto, employees were potentially exposed to struck-by hazards and crush injuries from forklift accidents due to trucks being moved while forklifts were still in the process of driving on and off the truck. Methods, devices, and/or controls were not utilized to prevent the trucks from pulling away from the loading dock while the forklifts were still in the process of driving on and/off the truck. The worksite has experienced a past history of accidents and near misses involving trucks pulling away from the dock while forklifts are still inside and/or just exiting the trucks cargo areas.
