29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: On or about May 16, 2013, and at times prior thereto, employees installing metal contact piping inside a 7 feet deep excavation were not provided a means of egress on the north west and south west areas of the excavation. Employees were exposed to struck-by hazards.

29 CFR 1926.651(i)(3): Sidewalks, pavements, or appurtenant structures had been undermined and a support system or another method was not provided to protect employees from the possible collapse of such structures: On or about May 16, 2013, and at times prior thereto, employees performing excavation activities were working next to a building and sidewalk where the soil was sloughing off from under the sidewalk. The employer did not provide any support or protective systems exposing the employees to the hazard of being struck by the soil and concrete.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person prior to the start of work, and as needed throughout the shift, for evidence of situations that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. On or about May 16, 2013 and at times prior thereto, the employer did not ensure inspections for evidence of hazardous conditions was conducted to protect employee exposure from cave-ins and struck-by hazards. Employees worked without protection from cave-ins and without a safe means of egress.
