29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provided for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.):  (a) Single-Family Home at 2680 Windsor Road, Windsor, Pennsylvania - The job site did not have a competent person in that the employer did not know that the work of tearing off the old roof and roof structure and rebuilding the roof structure and installing a new roof on the two-story high residence required fall protection, on or about May 17, 2013.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a) Single-Family Home at 2680 Windsor Road, Windsor, Pennsylvania - The employer and two employees worked on the attic level of the home preparing to rebuild the roof structure and roof of the home from the trusses up.  The employer did not provide guardrail systems, safety net systems, personal fall arrest systems or any fall protection nor did the employer demonstrate infeasibility or demonstrate that it created a greater hazard to use to fall protection to prevent employees from falling from 20 to 23 feet to the ground below, on or about May 17, 2013.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
