29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):   (a) On May 16th, 2013, at the B & W Brake Facility, employees were exposed to serious caught-in, crushing and or struck-by injuries, in that the forklift operators had not completed a competent training program.             Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.

29 CFR 1910.219(d)(1): Pulley(s) with part(s) seven feet or less from the floor or work platform were not guarded in accordance with the requirements specified in 29 CFR 1910.219(m) and (o):   (a) On May 16th, 2013, at the B & W Brake Facility, employees were exposed to serious caught-in, crushing and or struck-by injuries, in that the Pulley System on the Wheel O Breator Machine did not have a guard that fully enclosed the moving parts on all exposed sides.            Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.

29 CFR 1910.303(g)(2)(i): Except as elsewhere required or permitted by Subpart S of Part 1910, live parts of electric equipment operating  at 50 volts or more were not guarded against accidental contact by use of approved cabinets or other forms of approved enclosures or by any of the means identified in paragraphs (A), (B), (C), and (D) of 29 CFR 1910.303(g)(2)(i):    (a) On May 16th, 2013, at the B & W Brake Facility, employees were exposed to serious electrical shock, burn and or electrocution injuries, in that the electrical equipment operating at 50 volts or more was not guarded or enclosed to protect from accidental contact in the storage area did not have a guard that fully enclosed the electrical connections.            Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.
