On or about May 16, 2013, the employer did not ensure each employee was trained to recognize and avoid fall hazards and the procedures to follow to minimize those hazards. Employees, without fall protection, were performing framing work at a height of over 16 feet did not recognize hazards associated with falls.

29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor  did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.    On or about May 16, 2013, employees who were performing framing activities were not provided fall protection. The employees were exposed to falls of 16 feet to the ground below.
