29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: a. On or about May 15, 2012, at the above addressed jobsite, an employee was conducting water line operations in a trench approximately five (5) feet nine (9") inches in depth. The trench was not provided with cave in protection, thereby exposing the employee to cave in hazards. THE FATHER & SONS PLUMBING & SEWER, CORPORATION, WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.652(a)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 315180802, CITATION NUMBER 1, ITEM NUMBER 2 AND WAS AFFIRMED AS A FINAL ORDER ON MARCH 1, 2011, WITH RESPECT TO A WORKPLACE LOCATED AT 5140 W DEMPSTER STREET, SKOKIE, IL 60077.
