OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees who do not work safely from ladders. (a) Facility, Coal Conveyor Tunnel: On or about May 15, 2013, employees were working from 6 foot fiberglass step ladders and the following conditions existed: 1. While trying to unjam a coal chute employees will sit on the top of a 6 foot fiberglass step ladder. 2. Employees were not trained in the safe use of step ladders. 3. Employees and the 6 foot fiberglass step ladders were exposed to excessive side loading when employees would be working from the ladder and using a piece of electrical metal conduit to unjam the coal located in the coal chute. At least one employee has fallen off of a 6 foot fiberglass stepladder when doing this operation. Among other methods, one feasible and acceptable means of abatement would be to install additional vibrators on the coal chutes so that the coal does not become jammed.

29 CFR 1910.133(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: (a) Facility, Coal Conveyor Tunnel: On or about May 15, 2013, employees were getting coal dust in their eyes when they would work from a 6 foot fiberglass step ladder and push a 3/4 inch diameter piece of conduit into the opening of the coal chute to unjam the coal. The employees do wear wrap around safety glasses when they are performing this task, but the wrap around safety glasses do not prevent coal dust from getting into their eyes on a daily basis.
