29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:   a)  Hwy 167 South, Enterprise AL; On or about May 13, 2013 and at times prior thereto the employer exposed employees to worksite hazards in that the employer failed to instruct his employees in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to their work environment to control or eliminate any hazard(s) or other exposure to illness or injuries. Employees were working in a seven foot deep trench without any safety training regarding trenching and excavation work.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:    a) Hwy 167 South, Enterprise AL; On or about May 13, 2013 the employer exposed employees to cave-in hazards in that employees were not provided a means of safe egress while working in a 7 foot deep trench.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety.   a) Hwy 167 South, Enterprise AL; On or about May 13, 2013 the employer exposed employees to cave-in hazards in that employees were allowed to work inside of a trench measuring seven feet deep, twelve feet wide, and twenty-five feet in length that was dug in class "c" soil. The employer as the competent person failed to remove employees from the trench which did not have safe egress or cave-in protection.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 paragraph (b) or (c) of this section.   a) Hwy 167 South, Enterprise AL; On or about May 13, 2013 the employer exposed employees to cave-in hazards in that employees were allowed to work inside of a trench measuring seven feet deep, twelve feet wide, and twenty-five feet in length that was dug in class "c" soil. The employer had not complied with the standard in that employees were not protected from cave-ins by an adequate protective system and the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (thirty-four degrees measured to the horizontal).
