29 CFR 1926.404(b)(1)(i): Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites: a) On or about 05/20/13, on construction site, Building N, Maryner Apartments located at 186 Efner St.,Buffalo, NY: Employees used a DeWalt Compound Mitre Saw to cut vinyl siding, and also used a Mikita portable grinder. The saw and grinder were connected to 120- volt ac power via a series of two extension cords, the first of which was plugged into a wall receptacle just inside the apartment near the entrance. No GFCI or assured equipment grounding program was being used. NO ABATEMENT CERTIFICATION REQUIRED

They were exposed to a fall of approx. 16 ft. because no fall protection system was utilized. The roof pitch was estimated to be approx. 4 in 12. NO ABATEMENT CERTIFICATION REQUIRED

The ladder was on a paved surface in front of an entrance to the building and was not secured nor barricaded to prevent accidental displacement. NO ABATEMENT CERTIFICATION REQUIRED

The saw and grinder were connected to 120- volt ac power via a series of two extension cords, the first of which was plugged into a wall receptacle just inside the apartment near the entrance. The grounding prong on the plug of the first extension cord had fallen out and was actually taped to the cord. NO ABATEMENT CERTIFICATION REQUIRED
