OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by or falling from collapsing truss systems. On or about May 16, 2013 and at times prior thereto, the employer's temporary and permanent bracing practices were ineffective in preventing the collapse of the prefabricated wooden trusses being installed.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) Wall top plates and/or trusses: On or about May 16, 2013, the employer did not ensure a fall protection method was implemented and/or used while trusses were erected which exposed employees to falls up to 10-feet to the concrete slab or unfinished ground below.    b) Wall top plates and/or trusses: On or about May 15, 2013, the employer did not ensure a fall protection method was implemented and/or used while trusses were lifted with a crane or manually on to the walls which exposed employees to falls up to 10-feet to the concrete slab or unfinished ground below.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards:  a) Wall top plates and/or trusses: On or about May 24, 2013 and at times prior thereto, the employers safety training was ineffective in enabling employees in recognizing fall hazards and/or the safety precautions to avoid them which exposed employees to falls up to 10-feet to the concrete slab or unfinished ground below.
