29 CFR 1910.67(c)(2)(v): A body belt was not worn and a lanyard attached to the boom or basket when working from an aerial lift: (a) Goliath Tree and Lawn Service LLC on or about May 21, 2013, near the address of 908 W. 4th St Defiance, OH: The employer failed to ensure a worker performing tree trimming operations from an elevated vehicle mounted platform, utilized an appropriate fall protection system. The worker performing work in this condition was exposed to an approximant 35 ft. fall to the ground below.

29 CFR 1910.135(a)(1): The employer did not ensure that each affected employee wear a protective helmet when working in areas where there is a potential for injury to the head from falling objects: a) Goliath Tree and Lawn Service LLC on or about May 21, 2013, near the address of 908 W. 4th St Defiance, OH: The employer failed to ensure an employee was protected from head injuries while working below tree trimming operations being performed directly above. Without an appropriate form of head protection, the employee was exposed to potential impact injuries caused from falling material and/or equipment.
