Palo, Inc., 7355 Peach Street, Erie, PA 16509, intersection of Peach Street and Douglas Parkway, east side of the intersection, on or about May 21, 2013 and times prior thereto: Employees of the company were performing work in an excavation at depths ranging from 6.0 feet to 7.3 feet. The excavation consisted of near vertical walls and Type B soil. A means or method of excavation cave-in protection was not utilized.
