29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:  The employer does not ensure protective equipment is used in the form of a seatbelt when operating a forklift.  This violation was observed on or about May 21, 2013, in the Maintenance Shop where an employee was exposed to an ejection hazard when operating a forklift without donning a seatbelt.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that protective equipment is used when necessary whenever hazards capable of causing injury and impairment are encountered.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  The employer does not train operators in the safe operation of powered industrial trucks. This violation was observed on or about May 21, 2013, in the Maintenance Shop where employees were exposed to an ejection hazard when operating a Mitsubishi forklift without successfully completing the training consisting formal, practical and evaluation of the operator's performance.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that  each operator has successfully completed the training consisting of a combination of formal instrution, practical training and evaluation of the operator's performance in the workplace.

29 CFR 1910.254(b)(4)(iv): Terminals for welding leads were not protected from accidental contact by personnel or metal objects:  The employer does not protect employees from accidental contact with terminal of welding lead. This violation was observed on or about May 21, 2013, in the Maintenance Shop where employees were exposed to an electrical hazard when operating a Miller welding power source without covering the welding lead of the machine for potential accidental contact.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that terminals for welding leads are protected from accidental contact by personnel or metal objects.
