29 CFR 1926.501(b)(1): Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. (a) Thoutt Bros. Concrete Contractors, Inc. 275 S. Cherokee St., Denver, CO 80223; On and before May 21, 2013, the exposing employer did not ensure that employees performing concrete work on a walking/working surface with an unprotected side or edge 6 feet or more above a lower level were protected from falling by an adequate fall protective system. Condition exposed employees to fall hazards of approximately 20 feet as an employee reached for a concrete hose from a second floor balcony without fall protective measures in place.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards and ensure that the program enables each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. (a) Thoutt Bros. Concrete Contractors, Inc. Alta Alameda Station, 275 S. Cherokee St., Denver, CO 80223; On and before May 21, 2013, the exposing employer failed to provide his employees with a training program for each employee who might be exposed to a fall hazard and ensure that the program enable each employee to recognize fall hazard and minimize those hazards. Condition resulted in an employee exposed to a fall hazards from a second story balcony as he reached for a concrete pumping hose without any fall protective measures in place.
