29 CFR 1926.1413(c)(3)(ii): 29 CFR 1926.1413(c)(3)(ii):  A deficiency noted on the annual inspection was not monitored and the employer did not ensure that the deficiency was checked on the monthly inspections.     a) Cumberland River at Hwy 109 - On or about 5/21/13, the auxiliary cable was not monitored and checked on a monthly inspection after a deficiency was noted on the annual inspection     In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.1413(a)(4)(ii)(B): 29 CFR 1926.1413(a)(4)(ii)(B):  When a deficiency in Category II was identified, operations  involving  use of the wire rope in question was not prohibited until the wire rope was replaced.     a) Hwy 109 @ Cumberland River - On or about 5/21/13, damaged cables were not removed from service.       In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:  (Construction Reference 1926.103)(a) (LOCATION) (IDENTIFY SPECIFIC OPERATION/CONDITION) (DESCRIBE HAZARD)   a) Lay Down Yard, Gallatin, TN - On or about 6/17/13 -  employees wearing an N95 respirator were not trained on the information presented in appendix D of the respiratory protection standard.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
