OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. a) Outside the transfer station, on or about May 22, 2013, and at times prior to, the employer failed to provide impact protection from vehicular traffic for an above ground 250-gallon diesel storage tank, thus exposing employees to struck-by and fire hazard. Among other methods, one feasible and acceptable abatement method to correct this hazard is to: 1. Install barriers between vehicular traffic and the storage tank, where exposure to hazard will be eliminated according to OSHA and NFPA requirements or relocate to an area away from vehicle traffic. ABATEMENT CERTIFICATION REQUIRED.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: a) In the transfer station, on or about May 22, 2013, and at times prior to, employees operated the cardboard and paper baler machine without the guard door, exposing employees to amputation hazard.

29 CFR 1910.157(c)(1): The employer shall provide portable fire extinguishers and shall mount, locate and identify them so that they are readily accessible to employees without subjecting the employees to possible injury. a) In the transfer station, on or about May 22, 2013, and at times prior to, employees baled cardboards, papers, load trucks with trash and do clean up work. The employer had a fire extinguisher sign by the baler machine without fire extinguisher, exposing employees to fire hazards in case of fire emergency.
