29 CFR 1926.451(b)(7): On scaffolds where platforms are overlapped to create a long platform, the overlap was less than 12 inches (30 cm) where the platforms were not nailed together or otherwise restrained to prevent movement.  On or about May 22, 2013, and times prior thereto, two employees were working on a scaffold where unrestrained platforms were overlapped over supports to create a long platform and was not extended at least 12 inches (30 cm) to prevent movement. This condition exposed employees to fall hazards of greater than 10 feet to the ground below.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms. Guardrail systems were not installed before the scaffold was released for use by employees other than erection/dismantling crews.  On or about May 22, 2013, and times prior thereto, two employees were found performing plastering work on a scaffold platform at heights greater than 10 feet from the ground that was not provided with a guardrail system along all sides and ends of the platforms.  Guardrail systems were not installed before the scaffold was released for use by employees other than erection/dismantling crews.

29 CFR 1926.451(f)(15)(i): A ladder was placed against a structure which was not a part of the scaffold, and the scaffold was not secured against the sideways thrust exerted by the ladder.  On or about May22, 2013, and times prior thereto, two employees performing plastering work at heights greater than 10 feet from the ground were using a ladder to access a scaffold's platform.  The ladder was placed against the building and the scaffold was not secured against the sideways thrust exerted by the ladder.  This condition exposed employees to potential fall hazards.

On or about May 22, 2013, and times prior thereto, two employees were working on a scaffold platform where frames and panels were not braced by cross, horizontal, or diagonal braces, or combination thereof to secure scaffold vertical members laterally.  This condition exposed employees to fall hazards from heights greater than 10 feet to the ground below.

On or about May 22, 2013, and times prior thereto, two employees on a scaffold more than 10 feet (3.1 m) above a lower level were not protected from falling to the ground level. This conditon exposed employees to fall hazards.  Rafael Beltran Plastering was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard 1926.451(g)(1), which was contained in OSHA Inspection Number 313500845, Citation Number 01, Item Number 003 and was affirmed as a final order on August 23, 2011, with respect to a workplace located at 7501 N. Mesa, El Paso, TX, 79912.

29 CFR 1926.451(h)(2)(ii): A toeboard was not erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below.  On or about May 22, 2013, and times prior thereto, two employees were observed working on a scaffold platform more than 10 feet above a lower level where toe boards were not erected along the edge of the platform.  This condition exposed employees to struck-by hazards from falling objects.  Rafael Beltran Plastering was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1926.451(h)(2)(ii), which was contained in OSHA Inspection Number 313500845, Citation Number 01, Item Number 001(b) and was affirmed as a final order on August 23, 2011, with respect to a workplace located at 7501 N. Mesa, El Paso, TX. 79912.
