29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets.   a. Top Level of Building:  Employees working out of the scissor lift up between the metal trusses were not wearing hard hats when there was a possible danger of head injury in the event they would strike their head as observed on 5-22-13.   b. Lower Corner of Building Toward Office Trailer: Employee working out of the Sun Belt aerial lift was not wearing his hard hat when there was the possible danger of head injury from impact of the metal fascia cap that extended past the corner of the building as observed on 5-22-13.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.   a. First Floor: West Wall  Employees were exposed to a fall of approximately 11 feet 6 inches to the ground due to there was only 1 top rail installed at approximately 40 inches off the concrete floor per each of the three 14 feet wide openings as observed on 5-22-13.

29 CFR 1904.32(b)(3): The Summary of Work Related Injuries and Illnesses (OSHA Form 300A or equivalent) was not properly certified:   a.2012 OSHA Form 300 A:  The 2012 OSHA Form 300 A summary of work related injuries and illnesses was not certified by the highest ranking company executive at the facility. The facility's Safety Manager, not a company executive signed the summary, as determined on 5-22-13.   Abatement Note: Proper certification of the Summary of Work-Related Injuries and illnesses (OSHA form 300 A) requires a company executive to examine and determine based on their knowledge that the information was recorded correctly.  A company executive includes: owners, officers, and the highest ranking company official working at the establishment.
