29 CFR 1910.95(c)(1): The employer shall administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of 50% of the permissible exposure limit of 90 dBA (TWA): On or about June 13, 2013, in the facility, an employee required to operate the Roll Former machine was exposed to continuous noise at 72.2% of the permissible exposure limit of 90 dBA (TWA), or an equivalent sound level of approximately 87.7 dBA during a 504 minute sampling period. A continuing, effective hearing conservation program had not been instituted by the employer.

All repairs shall be made by authorized personnel: On or about June 13, 2013, in the facility, employees required to operate propane-powered forklift trucks were exposed to the hazard of carbon monoxide from exhaust emissions in excess of the recommended limit of 1%: Mitsubishi, Serial Number AF17B06070 - approximately 3.86% Mitsubishi, Serial Number AF17B01591 - approximately 3.83% Inhalation of excessive levels of carbon monoxide can result in headaches, nausea, and chemical anoxia.
