29 CFR 1926.102(a)(1): Employees shall be provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents. a) On or about May 22, 2013 at the worksite, the employer did not ensure that employees were provided and used eye protection while using a power actuated nail gun thereby exposing employees to a potential struck-by hazard.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a) On or about May 22, 2013 at the worksite, the employer did not ensure that employees were provided and used fall protection while performing framing work from the upper roof level, thereby exposing employees to an approximate 21 foot fall hazard. b) On or about May 22, 2013 at the worksite, the employer did not ensure that employees were provided and use fall protection while standing in the window/wall opening performing framing work, thereby exposing employees to an approximate 15 foot fall hazard. c) On or about May 22, 2013 at the worksite, the employer did not ensure that employees were provided and use fall protection while performing framing work from the lower roof level, thereby exposing employees to an approximate 11 foot fall hazard.
