29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    a) On or about 5/23/13 at commercial roofing construction site,  61 Perry St., Buffalo, NY:  Four employees engaged in roofing work were not trained to recognize potential hazards on this type of jobsite including but not limited to falls from roofs, ladders, and scaffolds, electrical hazards, and the need for personal protective equipment. They also were not trained in the applicable OSHA regulations to control or eliminate these hazards.    ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system:    a) On or about 5/23/13 at commercial roofing construction site, 61 Perry St., Buffalo, NY:  Four employees were exposed to a potential fall of approx. 15 ft. while on a flat roof doing roofing work. No fall protection system was utilized.      NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladders' length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    a) On or about 5/23/13 at commercial roofing construction site, 61 Perry St., Buffalo, NY:  Four employees were exposed to a fall of approx. 15 ft. when an extension ladder was used to access the roof from the ground. The siderails of the ladder only extended approx. 18 inches above the roof.     NO ABATEMENT CERTIFICATION REQUIRED
