OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards while performing work around damaged racks.  On or about May 23, 2013, employees were exposed to struck-by hazards while performing work around damaged racks.   The following racks were damaged: a.  Support post and brace on the corner OSD rack b.  Support post in the OSD rack at locations 7/8 near double door entrance  c.  Support post in the OSD rack at locations 12/13/14 in front of two single door entrances  d.  Support post in the OSD rack at locations 44/45   AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHODS TO CORRECT THESE HAZARDS IS: 1. The employer shall follow American National Standard Institute (ANSI) MH16.1:2008, Specification for the Design, Testing, and Utilization of Industrial Storage Racks, Section 1.4.1(2), which states, "The owner shall maintain the structural integrity of the installed rack system by assuring proper operational housekeeping and maintenance procedures  2. Regularly inspect for damage. If damage is found, immediately unload the affected area and replace or repair any damaged columns, beams, or other structural components.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been  taken out of service until restored to safe operating condition(s)     On or about May 23, 2013, employees were exposed to struck-by hazards when forklifts were not taken out of service when inspections discovered that repair was needed.  a.     On May 6, 7, 9, and 10, forklift 06 was operated with low coolant   b.     On May 16, 17 and 18, forklift 10 was operated with light problems on the PM shift(s)  c.     On May 22, 23, and 24, forklift 13 was operated with lights out on the PM shifts(s)  d.     On May 27, 28, and 29, forklift 13 was operated with light problems on the PM shifts(s)  e.     On May 20, forklift 06 was operated on PM shift(s) with obvious damage and leaks

29 CFR 1910.1200(g)(1): The employer did not have a material safety data sheet for each hazardous chemical in use:  On or about May 23, 2013, employees were exposed to chemical hazards when the employer did not have an MSDS for each chemical in use at the facility.   Employees were exposed to chemicals such as, but not limited to, propane, forklift engine coolant, forklift hydraulic fluid, and forklift brake fluid.
