29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet or more in depth so as to require no more than 25 feet of lateral travel for employees:  On or about May 23, 2013 at the above addressed jobsite, employees conducting sewer installation in a trench 6.2 feet in depth did not have a safe means of egress.  Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection by placing and keeping such materials or equipment at least 2 feet from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary was not provided.  On or about May 23, 2013 at the above addressed jobsite, employees installing a sewer line in an excavation were not protected from materials falling into the excavation, in that the spoil pile was less than two (2) feet from the edge of the excavation.  Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems.   On or about May 23, 2013 at the above addressed jobsite, an inspection of the excavation was not performed by a competent person, thereby exposing employees to the hazards associated with cave-ins.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c):  On or about May 23, 2013 at the above addressed jobsite, employees were installing a sewer line in a trench measured at 6.2  feet in depth.  The trench was not provided with cave in protection, thereby exposing the employees to cave in hazards.  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
