OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard while operating press brakes with a foot pedal that was not protected from unintentional operation with a cover:     a)  Bending Department - On and prior to May 23, 2013, press brakes including but not limited to the Chicago Press Brake (Size 254, Serial # L329) did not have a cover on the foot pedal to protect the operator from the unintentional activation of the press that did not have point of operation guarding.
