29 CFR 1926.453(b)(2)(iv): Employee(s) working in an aerial lift were sitting or climbing on the edge of the basket. The employer does not ensure employees working in an aerial lift do not sit or climb on the edge of the basket. This violation was observed on or about May 24, 2013, on the north side of the building where employees were exposed to fall hazards while operating a Genie Aerial Lift while painting the front entrance of the building and were sitting and climbing on the edge of the basket. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees do not sit or climb when operating aerial lifts.

1926.453(b)(2)(v): A safety harness with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: The employer does not ensure a safety harness with lanyard attached to the boom or basket was worn by employees working from an aerial lift. This violation was observed on May 24, 2013, on the north side of the building where employees were exposed to fall hazards while painting the front entrance of the building from a Genie Aerial Lift without wearing a safety harness with the lanyard attached to boom or basket. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees wear safety harnesses with the lanyard attached to the boom or basket when operating aerial lifts.
