29 CFR 1926.501 (b)(13) Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system. a) Ocean Avenue & West End Avenue, Long Branch, NJ: Employees were engaged in roof repair of a multi story residential apartment building at a height of approximately 16.9 feet without the use of fall protection, observed on or about 5/23/13. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii) a) Ocean Avenue & West end Avenue, Long Branch, NJ: Employees were performing roofing repair and replacement on a multi store apartment building approximately 16.9 feet above the ground. The employees were not trained in the proper use of fall protection and how to use it properly, observed on or about 5/23/13. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
