29 CFR 1910.1030(c)(1)(i): The employer having employee(s) with occupational exposure did not establish a written Exposure Control Plan designed to eliminate or minimize employee exposure:    (a) On or about 5/28/2013 at Albany Regional Sleep Disorder Center, sleep technicians who had contact with patients with non-intact skin and cough hemoptysis during patient handling and shaving, and administrative staff who cleaned contaminated surfaces and laundry, were exposed to bloodborne pathogen hazards because the employer failed to implement an effective exposure control plan.

29 CFR 1910.1030(d)(4)(i): The employer did not determine or implement an appropriate written schedule for cleaning or method of decontamination based upon the location within the facility, type of surface to be cleaned, type of soil present, and tasks or procedures being performed in the area:  (a) On or about 5/28/2013 at Albany Regional Sleep Disorder Center, sleep technicians who had contact with patients with non-intact skin and cough hemoptysis, and administrative staff who cleaned contaminated surfaces and laundry were exposed to bloodborne pathogen hazards because the employer failed to determine and implement an appropriate written schedule for cleaning and decontamination for equipment and surfaces in the facility that identified the appropriate cleaners for job tasks with potential occupational exposure.

29 CFR 1910.1030(g)(2)(i): The employer did not institute a training program and ensure employee participation in the program:  (a) On or about 5/28/2013 at Albany Regional Sleep Disorder Center, sleep technicians who had contact with patients with non-intact skin and cough hemoptysis, and administrative staff who had contact with contaminated surfaces and laundry were exposed to bloodborne pathogen hazards because the employer had not trained them in accordance with the standard.  Defiencies in staff knowledge related to bloodborne pathogen hazards included but were not necessarily limited to: the correct use of PPE for job tasks including handling of linens, the effective use of cleaners where blood or OPIM were potentially present, and the site-specific follow-up procedures to be taken following an exposure event.
