OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees operating and towing with ranch-owned vehicles and equipment:  a) On or about April 13, 2013, at at times prior thereto, young workers were permitted to operate vehicles, such as pick-up trucks, and machinery on the farm and adjacent roads without training and appropriate licensing.  b) On or about June 3, 2013, at at times prior thereto, workers were permitted to operate All-Terrain Vehicles (ATVs) without receiving appropriate safety training, including, but not limited to, the importance of wearing helmets. 29 CFR 1928.51(d): Every employee who operates an agricultural tractor was not informed of operating practices contained in Appendix A of this part and of any other practices dictated by the work environment.  a) The employer did not ensure training was provided to all workers operating multiple agricultural tractors on the ranch/farm.  Training deficiencies included, but was not limited to, not all being trained the requirement to where seatbelts, not permitting others to ride, and reducing speed when turning or crossing slopes. 29 CFR 1928.57(a)(6): At the time of initial assignment and at least annually thereafter, the employer did not instruct every employee in the safe operation and servicing of all covered equipment with which he was or would be involved:  a) On or about May 15, 2013, and at times prior thereto, workers engaged in sorting cut potato seed had not received training on safe operation of the sorting/cutting equipment, including, but not limited to, the importance of ensuring hazardous portions of the equipment are adequately guarded from contact.  b) On or about June 3, 2013, and at times prior thereto, workers engaged in feeding livestock using Power Take-Off (PTO) driven feeder had not received training on safe operation including, but not limited to, the importance of ensuring the the PTO couplers and and shaft were guarded from contact. 29 CFR 1928.57(b)(1)(iii): Power take-off driven equipment was not guarded to protect against employee contact with positively driven rotating members of the power drive system:    a) On or about June 3, 2013, and at times prior thereto, between the John Deere 5020 tractor and the feed wagon, the 1 inch square approximately 41 inch long PTO shaft guard was broken and not functional.  The master guard on tractor was missing, and the rotating shaft and couplers at both ends were exposed.    NOTE: Abatement certification is required for this item.
