OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees operating and towing with ranch-owned vehicles and equipment: a) On or about April 13, 2013, at at times prior thereto, young workers were permitted to operate vehicles, such as pick-up trucks, and machinery on the farm and adjacent roads without training and appropriate licensing. b) On or about June 3, 2013, at at times prior thereto, workers were permitted to operate All-Terrain Vehicles (ATVs) without receiving appropriate safety training, including, but not limited to, the importance of wearing helmets. 29 CFR 1928.57(b)(1)(iii): Power take-off driven equipment was not guarded to protect against employee contact with positively driven rotating members of the power drive system: a) On or about June 3, 2013, and at times prior thereto, between the John Deere 5020 tractor and the feed wagon, the 1 inch square approximately 41 inch long PTO shaft guard was broken and not functional. The master guard on tractor was missing, and the rotating shaft and couplers at both ends were exposed. NOTE: Abatement certification is required for this item.
