29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access: a) On or about 5/23/13, at the site of Batavia, NY. Ladder access was not provided for a mobile scaffold with 10 feet working platforms. Employee was climbing on the frames of the mobile scaffold. No Abatement Certification Required

29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system: a) On or about 5/23/13, at the site of Batavia, NY. Employees, working on removing old windows and replacing with new windows in the second floor, were not protected by the above-mentioned fall protection systems. The window parapet height was 23.5 inches. No Abatement Certification Required
