29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: (a) On or about May 28, 2013 - 2100 Richard Arrington Jr. Boulevard North, Birmingham, AL, a metal ladder being used by employees to get on an overhang where their suspension scaffold was positioned to pressure wash the exterior of the building did not extend at least 3 feet above the landing surface. Summit Waterproofing, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 315512749, citation number 01, item number 002 and was affirmed as a final order on 11/08/2011, with respect to a workplace located at 2603 Moody Parkway in Moody, AL 35004.
