OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. This violation occurred on or about May 14, 2013, employees working around the Komatsu excavator were not visible to the operator and there was no signalman/spotter assigned to notify the operator of employees in the hazardous areas of the machine exposing employees to the hazards of being struck by the equipment.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. This violation occurred on or about May 14, 2013, and at times prior thereto, employees performing temporary traffic control zone setup were not adequately trained how to protect themselves from moving construction equipment during this operation exposing employees to the hazards of being struck by construction equipment.
