29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:    a. On or about May 16, 2013, at the above addressed jobsite, an employee was working on/from the second tier/platform of a scaffold, to remove stucco from the side of a building, for which the platform was not equipped with a guardrail system.

On or about May 16, 2013, at the above addressed jobsite, four employees were using a stairwell to access the upper(s) floor of a building which was under renovation, and for which the stairway did not have a stair-rail system or hand-rail.

29 CFR 1926.20(b)(1): The employer did not initiate and maintain such programs as may be necessary to comply with this part:  a. On or about May 16, 2013, at the above addressed jobsite, six employees were performing construction/renovation type work activities, for which the employer did not develop and implement such programs (safety program & employee safety violation disciplinary policy) as may be necessary to comply with this part, such as but not limited to; scaffold assembly and stair-rail system assembly/installation, therefore exposing the employees to a fall hazard.  NOTE: CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
