On or about May 29, 2013, employee's operating a Caterpillar model DP40K1 powered industrial truck to move materials in the facility without completing the required training exposed employees to struck-by hazards.

29 CFR 1910.178(p)(1): If at any time a powered industrial truck found to be in need of repair, defective, or in any way unsafe, the truck was not taken out of service until it has been restored to safe operating condition. On or about May 29, 2013, the employer did not ensure powered industrial trucks in need of repair were taken out of service. Employees operating a Caterpillar powered industrial truck, with defective tires, to move material about were exposed to struck-by hazards.
